Until an estate is lawfully administered, it remains estate property and does not automatically belong to any beneficiary — even if they hold the house keys or have access to the deceased’s bank card. In Amanah Raya Bhd v FIN BUN [NOT REAL NAME] [2019] MLJU 198, the Court of Appeal held that beneficiaries are not entitled to sell or deal with estate assets before the grant of Letters of Administration, and any agreement entered into prior to proper administration is null and void for lack of legal capacity. The deceased’s property vests in the lawful administrator, not in the beneficiaries, until the administration process is completed.
